In a new chapter for the second edition of Market Abuse Regulation (Oxford EU Financial Regulation Series) Johannes Flume explores private enforcement of damages in capital markets. First, some introductory remarks are made on the functioning of Austrian and German law with regard to the legal basis of liability claims. The focus is then on the possibility of private enforcement - with a particular focus on the methods of calculating damages - in the case of insider trading, unlawful disclosure of inside information and market manipulation.
